DATA PROTECTION NOTICE

For the development and refinement of driver assistance and information systems as well as automated driving functions for active and passive safety and comfort functions, test vehicles of Automobili Lamborghini S.p.A. (“Lamborghini”) may record data from the environment using various sensors and video cameras in the vehicle. The recording mainly takes place on public roads. The recorded environmental information is then stored in a secure database and used for the development, refinement and maintenance of driver assistance and information systems as well as automated driving functions and comfort functions. These systems will use recorded video data to improve comfort and safety on the road and ensure vehicle functionality. Information about the existing traffic infrastructure and the detection of road users, including their direction of travel, must be processed to determine the correct response of the vehicle.

Lamborghini never identifies individuals in the data records.

In carrying out such activities, Lamborghini act as Data Controller and provides any data subject with the privacy policy below pursuant to Regulation (EU) 2016/679 (the General Data Protection Regulation, or “GDPR”) and applicable local laws.

Purposes of processing and legal basis
The personal data will be processed for the development and further development of driver assistance and information systems as well as automated driving functions and comfort functions. Your personal data is collected, processed and used on the basis of consideration of interests in accordance with Article 6(1), lit. f) of the GDPR. Lamborghini has a legitimate interest in processing your data for the refinement and development of driver assistance and information systems as well as automated driving functions and comfort functions. In certain cases, Lamborghini is legally obliged to correct these faults for reasons of product liability.

Categories of personal data processed
We may collect and process the following data:

  • Video recordings of the vehicle environment (images of other road users, vehicles, people, license plates and lettering on vehicles, lettering on stores and street signs, and other information that may be contained in the immediate vicinity of the vehicles),
  • Additional data from other vehicle systems (such as radar, LIDAR) as well as GPS position and timestamp of data collection.

Methods of processing and data retention period
Your personal data will be processed for the purposes specified above using automated tools, in accordance with the principles of confidentiality and the security measures prescribed by law. Only duly authorized personnel shall have access to your data.
We will retain your personal information only for as long as necessary to fulfil the purposes for which it was collected, including satisfying any legal or accounting requirements.

Entities who may access personal data
The data may be transferred to other entities when operating as data processors, in fulfillment of specific contractual obligations, which may include companies belonging to the VW Group, service provider, and suppliers of safety components. 
In addition, your personal data may be disclosed to public authorities (e.g., police or judicial bodies) when required by law or in response to official requests, in accordance with applicable legal obligations.
If your personal data is transferred to any recipients located outside the European Union Lamborghini will adopt adequate safeguards as provided under Articles 44 and following of the GDPR (e.g. the adoption of standard contractual clauses). Your personal data will be disclosed by Lamborghini to the appointed data processors and authorized personnel. It will not be disseminated.

Data subject rights
Pursuant to Articles 15-22 of the GDPR, you have the following rights, which Lamborghini is obligated to honor. The following are the most important rights you may exercise:

  • to obtain confirmation of whether Lamborghini holds your personal data;
  • to be informed of the source of your personal data, and of the purposes and methods of its processing;
  • to request the deletion, updating, correction, or integration of your personal data;
  • to request data portability;
  • to restrict or object to the processing of your personal data for legitimate reasons;
  • to withdraw your consent at any time;
  • to lodge a complaint to the competent supervisory authority;
  • to obtain identification details of the pata processors and the data controllers (e.g.,
  • the Italian Data Protection Authority – Garante per la Protezione dei Dati Personali).
